  • Transparent: We are open about our data practices and policies, specifying the purposes for which your personal data is collected and processed before it takes place.
  • Fair in Processing: We collect personal data in good faith and by legitimate means, and we process it only in accordance with the purposes for which it was collected.
  • Protective: We use commercially reasonable administrative, technical, and physical safeguards to protect your personal data, and we collect only what is necessary for our business needs.
  • Accountable: We take responsibility for our privacy practices and ensure that third parties we work with are also held to appropriate data protection standards.
  • Responsive to Privacy Requests: We are dedicated to honoring the privacy rights afforded to you by law, including your right to access and control your personal data.

1. Introduction: The Purpose and Reach of This Policy

Biocogent LLC (“Biocogent,” “we,” “us,” or “our”) is committed to protecting the privacy of personal information collected from visitors to our website, biocogent.com. This Privacy Policy outlines our data collection, use, and security practices and the rights you have concerning your personal information. This policy is designed to comply with the General Data Protection Regulation (GDPR), the ePrivacy Directive, and the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). We aim to be transparent about our data processing activities and will update this policy at least every 12 months to remain compliant with evolving regulations.

This Notice describes the types of personal data that Biocogent may collect or process when you interact with us through our website. By providing us your personal data or otherwise interacting with us, you are agreeing to this policy.

For the purpose of this policy, “personal information” means any information that relates to an identified or identifiable natural person.

2. Information We Collect and Why We Collect It

We collect personal information to provide our services, improve our website, and conduct business-related communications. The type of information we collect depends on your interactions with our site. We collect only the minimal contact information necessary to fulfill our purposes, aligning with the principle of data minimization.

Information You Provide to Us:

  • Contact Information: When you fill out a form on our website, such as a contact form or a request for information, we collect your name, email address, company name, and other business contact details you provide.
  • Login Information: To provide “elevated access” to our gated content, we collect and store your login credentials, which may include your name and email address. This information is collected to provide you with the services you requested and to manage your access to restricted content.

Information Collected Automatically:

  • Website Usage Data: When you visit our website, our servers and third-party services, including Google Analytics and Search Console, automatically collect certain information about your device and browsing activity. This may include your IP address, browser type, operating system, and the pages you visit. This data is collected to understand how visitors interact with our site, to improve website performance, and to measure the effectiveness of our marketing efforts.
  • Cookies and Tracking Technologies: We use cookies and other tracking technologies, such as pixels, to collect information about your browsing behavior. These technologies help us remember your preferences, provide you with relevant content, and support our marketing activities, including re-targeting and behavioral advertising. Under GDPR, we will only deploy non-essential cookies and tracking technologies after we have obtained your explicit, opt-in consent.
  • Unique Mobile Ad IDs (MAIDs): Our geo-fencing and advertising campaigns may collect unique mobile ad IDs to measure the effectiveness of our campaigns and to provide you with personalized advertising. We will only collect and use this information for advertising purposes after obtaining your explicit consent in accordance with applicable laws.

We may also combine information we collect from you with information we obtain from other sources to help us maintain and improve our services.

Third party links. Biocogent’s website may provide links to third-party websites for your convenience and information. These third-party websites operate independently from us, and we do not control their privacy practices. Biocogent therefore has no responsibility or liability for the content and activities of these linked websites. We encourage you to review the privacy policies of any third-party websites that you use to better understand their privacy practices.

Children Under Thirteen. Biocogent’s website services are directed to businesses and not to persons under the age of 13. We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with personal information without consent, he or she should contact us at info@biocogent.com. If we become aware that a child under 13 has provided us with personal information, we will delete his or her personal information from our files.

3. How We Use Your Information

We use the information we collect for the following specific and legitimate purposes:

  • To Provide Services: We use your login information to give you access to gated content, to verify your identity, and we use your contact information to respond to your inquiries, provide customer support, and manage our business relationship with you.
  • For Marketing and Communication: With your consent or where we have a legitimate interest, we use your contact information to send you marketing communications and business updates. We use data from cookies and tracking technologies to personalize our marketing campaigns and provide you with relevant advertisements. We may also use this information to generate aggregate and statistical data to help us understand and improve our services.
  • To Measure and Improve Our Website: We use aggregated and anonymized usage data to analyze website traffic, understand user behavior, and improve the design and functionality of our website and services. We use Google Consent Mode v2, which allows Google to model user behavior and conversions based on aggregated data, even if you do not consent to analytics cookies. This helps us continue to measure and optimize our marketing effectiveness while respecting your privacy choices.
  • To Ensure Security and Compliance: We use personal information to maintain the security of our website, prevent fraud, and comply with our legal obligations.

4. Third-Party Services & Disclosures

We use the following third-party services to help us manage and process your personal information. Our third-party service providers are required to execute agreements that include confidentiality requirements and will only process your personal data as necessary to perform their functions.

  • Ketch Consent Management Platform (Ketch CMP): We use Ketch to manage and record your consent preferences for cookies and other tracking technologies. Ketch is a Google-certified CMP that ensures our website’s consent banner and tracking mechanisms comply with both GDPR’s opt-in and CCPA/CPRA’s opt-out requirements. It also provides tools for automated Data Subject Access Request (DSAR) fulfillment.
  • HubSpot: We use HubSpot for our Customer Relationship Management (CRM) and to manage forms on our website. When you submit information through a form, it is stored securely in HubSpot, which automatically logs your consent and provides a dedicated tool for managing your data privacy rights.
  • Google Analytics and Search Console: We use Google Analytics and Search Console to analyze website traffic and performance. We have implemented Google Consent Mode v2 to ensure that your consent preferences are communicated directly to Google’s services.
  • Re-targeting and Geo-fencing Pixels: We use retargeting pixels to run geo-fencing and targeted advertising campaigns. These pixels collect data about your browsing activity to serve you relevant ads on other platforms. Under the CCPA/CPRA, this activity is considered “sharing” of personal information.

5. International Data Transfers

As an international company, we may transfer personal information to the United States, where our primary servers and certain third-party service providers are located. This is a crucial aspect of our operations, and we are committed to ensuring your data remains protected.

For the personal information of EU/EEA residents, we rely on legally recognized data transfer mechanisms to ensure your data receives an equivalent level of protection as in the EU. These safeguards may include:

  • Standard Contractual Clauses (SCCs): These are pre-approved contractual clauses that require the data recipient to adhere to strict data protection standards and provide appropriate safeguards for your information, including ensuring you have enforceable rights and legal remedies.
  • EU-US Data Privacy Framework: We may transfer data to US companies that are certified under the EU-US Data Privacy Framework, which has been deemed by the European Commission to provide an adequate level of data protection.

We also commit to performing a transfer impact assessment to review the risks of transferring your data to a third country and to implement additional safeguards where necessary to ensure its protection.

6. Your Data Privacy Rights

You have specific rights regarding your personal information, which we are committed to honoring.

  • For EU/EEA Residents (under GDPR):
  • Right to Access: You have the right to request a copy of the personal information we hold about you.
  • Right to Rectification: You can ask us to correct any inaccurate or incomplete personal information we have about you.
  • Right to Erasure (“Right to be Forgotten”): You have the right to request that we delete your personal information in certain circumstances.
  • Right to Data Portability: You can request to receive your personal information in a structured, commonly used, and machine-readable format.
  • For California Residents (under CCPA/CPRA):
  • Right to Know: You can request to know the categories and specific pieces of personal information we have collected about you, the sources of that information, and the purposes for which it was collected.
  • Right to Correct: You have the right to request the correction of inaccurate personal information we maintain about you.
  • Right to Delete: You can request that we delete the personal information we have collected from you, with some exceptions.
  • Right to Opt-Out of Sale or Sharing: You have the right to tell us not to sell or share your personal information. As described above, the use of tracking technologies for cross-context behavioral advertising is considered “sharing” under California law. We respect the Global Privacy Control (GPC) signal and will treat it as a valid opt-out request.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.
  • Right to Appeal: You have the right to appeal a denied request.

To exercise any of these rights, please use our dedicated DSAR submission form on our website or contact our Consent Management Platform Officer at the email address provided below.

7. Global Privacy Control (GPC) and “Do Not Track” Signals

Biocogent respects the Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of your personal information, in accordance with California law. The GPC is a browser-enabled setting that automatically signals your privacy preferences to websites you visit. When our website receives a GPC signal, it will automatically treat this as a request to not share your personal information for cross-context behavioral advertising.

However, please note that our website does not respond to older “Do Not Track” signals that are not part of the GPC framework, as there is currently no universal standard for how these signals should be interpreted.

8. Data Security

We take commercially reasonable administrative, technical, and physical measures designed to safeguard the personal information we collect and store against unauthorized access, loss, or misuse. These measures include:

  • Secure Hosting: Our website is hosted on WP Engine, which provides enterprise-grade security features such as a Web Application Firewall (WAF), Distributed Denial of Service (DDoS) protection, and an advanced Content Delivery Network (CDN) to filter malicious traffic.
  • Data Encryption: All data on WP Engine’s servers is encrypted at rest and in transit by default to ensure its confidentiality and integrity.
  • Application-Level Security: To protect the user data in our WordPress database, we implement measures such as enforcing strong, unique passwords, using Two-Factor Authentication (2FA) for logins, changing the default database prefix, and applying the principle of least privilege to user roles. We may also use a plugin to encrypt sensitive user fields for an additional layer of protection.
  • Retained personal information at Biocogent: Your personal information is contained behind protected networks with limited and controlled access by persons who have a duty of confidentiality and a need-to-know the information to perform their job function.

While we employ these security measures, no system can be 100% secure, and we cannot guarantee the absolute security of your information.

9. Data Retention

We generally retain personal information for as long as needed to fulfill the specific business purpose for which it was collected, or for a longer period if required by law or for other necessary business purposes. We have established clear data retention schedules for different types of information, and the retention period may vary depending on the nature of the data and your relationship with our company. When personal information is no longer needed for its stated purpose, we will securely delete it. Whenever possible, we aim to anonymize the information or remove unnecessary identifiers from records that we may need to keep for longer periods.
